However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all services we provide. You agree to purchase services from Got Guides at your own risk and conduct your own independent research into the services offered. All content is generated by users and not verified by Got Guides. Use information found on this Got Guides at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. BY SIGNING THIS TERMS AND CONDITIONS YOU AGREE THAT GOT GUIDES IS NOT LIABLE FOR ANY INJURY THAT OCCURS ON ANY TOUR/SERVICE BOOKED THROUGH GOT GUIDES
Except where prohibited by law, by using this Got Guides you indemnify and hold harmless Got Guides LLC. and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of Got Guides or your violation of these Terms and Conditions. By accepting these terms and agreements you are hereby agreeing and acknowledging that you are releasing Got Guides LLC, from any liability regarding the service that you are purchasing on Got Guides. The service being provided is between the purchaser (tourist/guest) and the service provider (tour guide). Got Guides is solely the connection between the purchaser (tourist/guest) and the service provider (tour guide) and as such will be released of liability for any events that happen during the service being provided to the purchaser.
The third party suppliers providing accomodations, flight, rentals, experiences, restaurants, or other travel arrangements travel or other services on or through the services are independent contractors and not agents or employees of the Got Guides LLC company. Got Guides LLC company is not liable for the acts, errors, omissions, representations, warranties, breaches or negligence of any such suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting therefrom. Got Guides LLC has no liability and will make no refund in the event of any delay, cancellation, overbooking, strike, force majeure or other causes beyond its direct control, and it has no responsibility for any additional expense, omissions, delays, re-routing or acts of any government or authority.
Subject to the foregoing, you use the services at your own risk and in no event shall the Got Guides LLC company (or their officers, directors and/or employees) be liable for any direct, indirect, punitive, incidental, special, or consequential losses or damages or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption of any type arising out of, or in any way connected with, your access to, display of or use of the services or with the delay or inability to access, display or use the services (including, but not limited to, your reliance upon reviews and opinions appearing on or through the services; any viruses, bugs, trojan horses, information, software, linked sites, products, and services obtained through the services (including, but not limited to any Got Guides LLC company syncronization product); personal injury or property damage, of any nature whatsoever, resulting from your use of the services’ servers and/or any and all personal information and/or financial information stored therein; any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content; or otherwise arising out of the access to, display of or use of the services) whether based on a theory of negligence, contract, tort, strict liability, or otherwise, and even if Got Guides LLC or its corporate affiliates has been advised of the possibility of such damages.
These Terms and Conditions are governed by the laws of the State of Colorado, United States of America.
Subject to any exceptions specified in these Terms and Conditions, if the user (customer) and Got Guides LLC. are unable to resolve any dispute through informal discussion, then the user (customer) and Got Guides LLC. agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator will be a neutral party selected by Got Guides LLC. Any fees associated with the use of an independent mediator or arbitrator will be paid for by the individual who is filing a grievance against Got Guides LLC.
Notwithstanding any other provision in these Terms and Conditions, you and Got Guides LLC. agree that you both retain the right to bring an action in small claims court and to bring an action for injunctive relief or intellectual property infringement.
The liability conditions supercedes all other terms and conditions..
These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way Got Guides operates and the way customers are expected to behave on Got Guides tours. Got Guides will either notify customers by email of changes to these Terms and Conditions, post a notice on Got Guides or users can refer to the terms and conditions effective date to make sure they are viewing the most current version.
